The Texas listing agreement is a legal document which is executed by a property owner and a real estate broker wherein the broker is given the authority to sell or lease the owner’s property for a commission. The agreement form must describe the property and its location, the listing price, the broker and seller’s duties, the broker’s compensation, and the expiration date. The Texas Real Estate Commission (TREC) has created a contract (the TREC Contract) called the One to Four Family Residential Contract, sometimes referred to as the Texas Real Estate Contract. This contract is the most commonly used residential contract in the state of Texas and is readily available on the TREC’s website, along with other TREC promulgated forms. Texas real estate contracts are legal documents that will be used for the sale or purchase of real estate and are available in several forms. Family Residential Contract There are several types of residential sales contracts that can be used in Texas, but the most common is the One to Four Family Residential Contract.

It is important that buyers understand the contract they are signing and how they can step away if they no longer want the property. Only after both parties sign the agreement will the sale be official and legally binding.
